Texas Tier II chemical reporting
The Tier II Chemical Reporting Program of the Texas Commission on Environmental Quality (TCEQ) is the state repository for the chemical inventory reports that facilities file under the federal Emergency Planning and Community Right-to-Know Act and the Texas Community Right-to-Know Acts. A Tier II report gives information about the facility, the hazardous chemicals it stores, and its emergency contacts.
In a Phase I ESA
ASTM E1527-21 does not name Tier II reports among its standard record sources. A Tier II record is a record of storage, not of a release.
- It shows what was kept on site. A report lists hazardous chemicals stored at a facility. It says nothing about whether any of them reached soil or groundwater.
- Small quantities are not reported. Reporting is required only when a facility stores a hazardous chemical at or above the threshold at any one time. A facility with no Tier II record may still have stored chemicals below the thresholds.
- Gas stations have their own, higher line. For retail fuel stations with compliant underground tanks, the thresholds are 75,000 gallons of gasoline and 100,000 gallons of diesel, so a station can store fuel and not appear here. The tank record for a station is the Petroleum Storage Tank registration.
- The history runs deep. TCEQ says it must keep all Tier II reports for 30 years. The pages read for this entry do not say how a member of the public obtains a facility's reports, so ask the program.

A chemical is hazardous for this purpose if the facility must keep a Safety Data Sheet for it under federal workplace safety rules. Annual reports are due by March 1. TCEQ says it receives about 80,000 Tier II reports each year.
