Aboveground Storage Tank (AST) Program
The Aboveground Storage Tank (AST) Program of the North Dakota Department of Environmental Quality (DEQ) is one of the programs of DEQ's Office of the Director. DEQ says the program works with owners and operators of aboveground storage tanks to ensure that compliance, leak detection, new installations, upgrades and tank closures are in accordance with North Dakota's Aboveground Storage Tank Rules.
In a Phase I ESA
ASTM E1527-21 lists state registered storage tank records as a standard source, and the general reading of a registered tank listing is on the UST / AST page. The AST Program's page links no list of aboveground tanks. This handbook pairs North Dakota's registered tank record type with the registry kept by the Underground Storage Tank (UST) Program instead, because that is the tank registry DEQ links.
Two records on the pages read reach aboveground tanks.
- The UST facility list. DEQ says: "The UST facility list does not distinguish between Aboveground (AST) or Underground Storage Tank systems."
- The Fund's registration. DEQ says all owners or operators of aboveground or underground petroleum storage tanks in North Dakota are required to register their tanks with the Petroleum Tank Release Compensation Fund (PTRCF) and pay an annual registration fee for each tank. The AST page links the Fund's page under additional tank information.
DEQ's UST Program page also links the North Dakota Fire Marshal's pre-installation application for aboveground fuel storage tanks at fuel dispensing sites; the pages read do not say what the Fire Marshal keeps.
For an aboveground tank on or near the property, check the UST facility list, and ask DEQ, through an open records request, whether the Fund holds a registration for the tank; the pages read give no public list of registrations.
The law and the forms
The AST page links the program's Century Code and rules. The Fund's page gives the statute as chapter 23.1-04.1 of the North Dakota Century Code. The AST page also links one form, an AST 30-Day Walkthrough, and the Fund's page links a Tank Removal and Cleanup Guidelines document and a form for the sale or disposal of petroleum storage tanks.
Where to look a site up
- The pages read link no search or list of the AST Program's own.
- DEQ gives the AST program mailbox, ndast@nd.gov, for questions about aboveground tanks. DEQ's main office is at 701-328-5150.
Getting the file
DEQ takes open records requests at DEQOpenRecords@nd.gov, on its General Request Form for general records. What to put in a request is on the Open Records Requests page.
