Superfund Program

Agency South Dakota Department of Agriculture and Natural Resources

Superfund is the usual name for the federal Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA), and for the trust fund Congress set up for emergencies and for hazardous waste sites that need long-term cleanup. In South Dakota, the Department of Agriculture and Natural Resources (DANR) takes part through its Minerals, Mining, and Superfund Program. DANR says the program carries out Superfund assessments across the state and provides state regulatory oversight at Superfund sites.

In a Phase I ESA

The lists themselves are federal. They are described on the NPL page and the SEMS page. What DANR adds is a state view of the work.

  • Release sites are assessed. The program's page says assessments take place at hazardous substance release sites to find out what the contamination is and how far it reaches, to judge the risk, and to decide on the right cleanup. It says the state conducts regulatory oversight both at sites being assessed or cleaned up through Superfund and at National Priorities List sites.
  • DANR describes each listed site. DANR's Superfund page has a section for the sites on the National Priorities List in South Dakota and another for sites deleted from it, each with a description and the year listed and, for deleted sites, the year removed. For a property near one of them, read DANR's description beside EPA's records.
  • Some documents are online. For some sites, DANR says documents have been placed in its Tanks and Spills Map database under a DANR ID number that the page gives.
  • The pages read name no separate state Superfund list. In the South Dakota overview, the state Superfund equivalent record type is left unpaired for that reason.

Where to look a site up

  • DANR's Superfund Program page describes the listed and deleted sites in South Dakota.
  • The Tanks & Spills Map holds documents for some sites, under the DANR ID number the Superfund page gives.
  • The Minerals, Mining, and Superfund Program is at (605) 773-4201, and DANR's mailbox is DANRmail@state.sd.us.

Getting the file

DANR's page footer links Request Public Records, an address on the state's sd.gov portal that this handbook did not open. The pages read do not say what DANR keeps on Superfund sites beyond the documents in its online database, or what a request must include. Ask EPA separately for its own records on a site.
