Hazardous Waste Management Program

Agency Mississippi Department of Environmental Quality

The Mississippi Department of Environmental Quality (MDEQ) says it is delegated to manage the majority of the hazardous waste management program in Mississippi. The program, in MDEQ's Waste Division, regulates hazardous waste generation, transportation, storage, treatment and disposal under the Mississippi Solid Waste Disposal Law (Miss. Code Ann. ยง 17-17-1 et seq.) and the Mississippi Hazardous Waste Management Regulations, 11 Miss. Admin. Code Pt. 3, Ch. 1.

In a Phase I ESA

ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single Mississippi list with that type: the pages read link no MDEQ list of hazardous waste facilities. The Hazardous Waste Program page links a Hazardous Waste Services Providers document, which this handbook did not open. The federal records beside it are described on the RCRA Generators page, the RCRA TSD page and the RCRA CORRACTS page. Four Mississippi details shape the search.

  • Corrective action stays with EPA. MDEQ says it is not currently authorized by EPA to administer the HSWA Corrective Action portion of the RCRA program, and that EPA continues to manage that area in Mississippi in coordination with MDEQ. For a facility with a corrective action history, ask EPA as well as MDEQ.
  • What MDEQ does with EPA. MDEQ lists the permitting of hazardous waste storage, treatment and disposal facilities; compliance and enforcement at those facilities; the management of hazardous waste by generators of various sizes; the registration of hazardous waste transporters; the monitoring and remediation of permitted hazardous waste units; and used oil and household hazardous wastes.
  • Generators report every year. MDEQ says Mississippi law requires each generator of more than 220 pounds of hazardous waste in any calendar month, each transporter, and each owner or operator of a facility that treats, stores, recycles or disposes of hazardous waste to report annually to MDEQ the types and amounts handled in the preceding calendar year. MDEQ reports the data to EPA every two years. Beginning January 22, 2025, large and small quantity generators must register and keep an account in EPA's RCRAInfo. A generator's annual reports are MDEQ records to ask for.
  • Waste compliance sits in the Waste Division. MDEQ's Environmental Compliance and Enforcement Division page says compliance and enforcement for hazardous and nonhazardous waste permits and regulations is carried out by the Waste Division.

MDEQ's route is a written public records request that names the facility, the city and county where it is located, and the type of information wanted; see Public records requests.
