Pennsylvania Hazardous Waste Program

The hazardous waste program of the Pennsylvania Department of Environmental Protection (DEP) regulates the generation, storage, transportation, treatment and disposal of hazardous waste. Its Division of Hazardous Waste Management writes the regulations, licenses transporters, and gives guidance on permitting and compliance monitoring. DEP's regional Solid Waste Management Programs perform the inspections and enforce the regulations.

In a Phase I ESA

ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single Pennsylvania list with that type; DEP's two lists of permitted facilities are the Pennsylvania records that bear on it.   • Two lists, by whose waste it is. A commercial treatment, storage and disposal facility is permitted to store, treat and dispose of hazardous waste generated off site and received from other companies. A captive facility is permitted to store, treat or dispose of hazardous waste that it generates itself. A plant that stores or treats its own waste under a permit is the kind of facility the captive list covers, so check both.
  • The lists are dated. The commercial list says it was last updated on May 3, 2024, and the captive list on September 28, 2023. Confirm a facility's current status in eFACTS.
  • Generators are not listed here. DEP says a generator must file a notification of regulated waste activity to obtain an EPA hazardous waste identification number, use licensed transporters, and ship to a permitted facility. Notifications go to the Division of Hazardous Waste Management, on paper or through DEP's electronic form. The hazardous waste pages read give no DEP list of hazardous waste generators, so the federal generator record is the place to look.
  • The division coordinates corrective action. The division coordinates the RCRA Corrective Action Program, and its page for that program links the agreement between DEP and EPA. See the One Cleanup Program page.

What the record shows

Both lists are tables grouped by DEP regional office. Each row gives the facility name, linked to its eFACTS record, the EPA ID number, the address, the county, the host municipality, and a short description of what the facility does. The commercial list adds a phone number.

The descriptions are specific. They say what kind of waste a facility stores or treats and in what kind of unit, and DEP's wording can note that units are going through closure. Read the description for the operations it names, then use the EPA ID number to match the facility to the federal record.

Among the statutes DEP lists for its waste programs is the Solid Waste Management Act, Act 97 of 1980. DEP lists the hazardous waste regulations as Article VII, and says Pennsylvania incorporates the federal regulations by reference.

Getting the file

DEP's waste management program is in all of its regional offices. DEP recommends an Informal File Review, requested on an electronic form and scheduled with the regional office, before a request under the Right-to-Know Law.
