Texas Innocent Owner/Operator Program (IOP)

The Innocent Owner/Operator Program of the Texas Commission on Environmental Quality (TCEQ) gives a certificate to an owner or operator whose property is contaminated by a release or migration from a source that is not on the property, and who did not cause or contribute to that source. The certificate is called an Innocent Owner/Operator Certificate (IOC).

In a Phase I ESA

ASTM E1527-21 does not name innocent owner programs among its standard record sources, so no search distance attaches to this list under the standard. It still matters, because of what a certificate says about the property.

  • A certificate means the property is contaminated. The program certifies innocence, not cleanliness. To qualify, the applicant submits a site investigation report showing that the property became contaminated from an off-site source.
  • It points at a source somewhere else. The off-site source may have its own record. Look for it under the program that would regulate it.
  • It does not pass to the next owner. TCEQ says that, unlike the liability release under the Voluntary Cleanup Program, the immunity in an IOC does not cover future owners or operators. A later owner or operator must apply separately, and can do so only after becoming the owner or operator.
  • It can come with restrictions. TCEQ may require restrictive covenants or other measures to protect human health and the environment, and the innocent owner must grant reasonable access to the property for investigation or remediation.

The program was created by House Bill 2776 of the 75th Legislature. Its statute is Texas Health and Safety Code sections 361.751 to 361.754, and its rules are 30 Texas Administrative Code sections 333.31 to 333.43.

TCEQ offers three routes to its records: TCEQ Records Online for records already scanned, an email to the Central File Room (cfrreq@tceq.texas.gov) to view or copy paper and microform records, and a Public Information Request for records that are not available through the file room or that contain confidential information.
