Hazardous Waste Program (HWP)

Agency North Dakota Department of Environmental Quality

The Hazardous Waste Program (HWP) of the North Dakota Department of Environmental Quality (DEQ), in its Division of Waste Management, regulates the generation, treatment, recycling, storage, transportation and disposal of hazardous waste and used oil, to ensure that hazardous waste management in North Dakota complies with the state's Hazardous Waste Management Rules. DEQ says North Dakota is an authorized state, which means the HWP implements the requirements of the Resource Conservation and Recovery Act (RCRA) in place of EPA. The HWP also oversees polychlorinated biphenyls (PCBs) and the Brownfields Program.

In a Phase I ESA

ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single North Dakota list with that type; the HWP's records bear on it. They sit beside the federal records described on the RCRA Generators page, the RCRA TSD page and the RCRA CORRACTS page. Four North Dakota details shape the search.

  • Permitted facilities are listed with their permit type. DEQ's Permitted Facilities page lists each permittee with the kind of permit it holds, among them storage, treatment, post closure and corrective action, and each permit type links a document. Where the permit type names corrective action, read the linked document.
  • Regulated generators need a site identification number. DEQ says the Hazardous Waste Management Rules require regulated generators of hazardous waste to have a site identification number, that conditionally exempt generators are exempt from this requirement, and that North Dakota uses the federal notification form for RCRA Subtitle C activity. DEQ says North Dakota has opted into myRCRAid, which lets sites submit that form electronically.
  • DEQ points to EPA for compliance data. DEQ's Data & Maps page says all hazardous waste compliance and superfund site data is available through EPA Region 8, and links EPA's Enforcement and Compliance History Online (ECHO) database and the RCRAInfo Web Application.
  • Inspections leave a report. DEQ says the HWP conducts compliance evaluation inspections at facilities that generate, treat, store, transport, dispose or recycle hazardous waste, reviewing documentation such as manifests, contingency plans, waste analysis results, biennial reports and training records. The Division's policy is to complete the inspection report within 45 days, and a copy goes to the facility, with any violations noted and a time for correcting them, usually within 20 days. Ask for the inspection reports and any violation follow-up for a facility on or near the property.

DEQ says that under the Hazardous Waste Management Rules, fines of up to $25,000 per day per violation may be assessed. The program's law is chapter 23.1-04 of the North Dakota Century Code, and its rules are Article 33.1-24 of the North Dakota Administrative Code. The Division's page links an October 1, 2026 rule update summary.
