Oklahoma Tier II chemical reporting

The Oklahoma Department of Environmental Quality (DEQ) is the state's central repository for Tier II reports, the yearly chemical inventories that facilities file under the federal Emergency Planning and Community Right-to-Know Act. Facilities file electronically, and DEQ distributes the reports to Local Emergency Planning Committees and fire departments statewide.

In a Phase I ESA

ASTM E1527-21 does not name Tier II reports among its standard record sources, so no search distance attaches to them under the standard. A Tier II record is a record of storage, not of a release.

  • It shows what was kept on site. DEQ describes a Tier II report as a chemical inventory. The report says nothing about whether any chemical reached soil or groundwater.
  • Only facilities at or above the thresholds file. DEQ says facilities containing chemicals at or above EPA thresholds must submit a report each year. A facility with no Tier II record may still have stored chemicals below those thresholds.
  • You can check whether a facility filed. DEQ publishes maps for locating a Tier II report filed in 2025 and in 2026, under the heading "Unsure if your facility filed a Tier II Report?". DEQ also says this information must be made available to the public.

Reports are due to DEQ by March 1 of each year.

Getting the file

The Tier II page does not say how to request a filed report. DEQ's general records route is its Central Records office: an online request form, in person at 707 N. Robinson in Oklahoma City, or by phone at 405-702-1188.
