Aboveground Storage Tanks

Agency Mississippi Department of Environmental Quality

The Mississippi Department of Environmental Quality (MDEQ) says that "In Mississippi all aboveground tanks are regulated by the Environmental Protection Agency (EPA)." It says EPA's Aboveground Storage Tank Program is run by EPA Region 4's Emergency Response Program. MDEQ's own tank program covers underground tanks.

In a Phase I ESA

The general reading of a registered tank listing is on the UST / AST page. In Mississippi, the pages read describe an MDEQ registration program for underground tanks and describe no MDEQ list of aboveground tanks. Three details from MDEQ's pages shape the search.

  • The line is 10 percent. MDEQ defines an underground tank as any tank, including underground piping connected to the tank, that has at least 10% of its volume underground, and says EPA and local fire marshals regulate aboveground tanks. A partly buried tank can therefore fall under MDEQ's Underground Storage Tank Program.
  • Local rules too. MDEQ says to check also with the local Fire Marshal's office and with city and county governments for any regulations they might have on aboveground tanks.
  • Propane is separate. MDEQ says aboveground propane tanks are regulated by the L C Gas Division of the Insurance Department, and that propane tanks are regulated, but not by its UST Program.

MDEQ's aboveground tank page links EPA pages on oil spill prevention plans and on reporting oil spills.

Where to ask

  • EPA Region 4. MDEQ's page gives a contact in Region 4 for aboveground tank questions.
  • Local offices. The local fire marshal, and the city and county governments, for any local rules.
  • Propane. The Insurance Department's L C Gas Division, at (601) 359-1064.
  • A spill. MDEQ says to report any spills to the 24-hour State Warning Point at 1-800-222-6362.

Getting the file

The pages read do not say where aboveground tank records are kept or how to request them. For any MDEQ record about a property, the route is a written public records request; see Public records requests.
