Hazardous Waste Section
The Hazardous Waste Section of the Waste Management Program of the South Dakota Department of Agriculture and Natural Resources (DANR) regulates how hazardous waste is stored, treated, transported and disposed of in the state. DANR says the section also gives technical help, inspects, investigates complaints, and assigns generator identification numbers. The program page describes the section's work as enforcing the hazardous waste rules that apply to generators and transporters, and to used oil and universal waste.
In a Phase I ESA
The section assigns generator identification numbers. The generator records sit beside the federal records described on the RCRA Generators page, the RCRA TSD page and the RCRA CORRACTS page. ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single South Dakota list with that type. The distances the standard sets for each kind of record are on the search distances page.
Three South Dakota details shape the search.
- DANR points to EPA's data. Under its heading for hazardous waste data, DANR's page links EPA's RCRAInfo, EPA's lists and maps of hazardous waste generators, and EPA's inspection and enforcement lists. The pages read link no South Dakota list of generators. Under a heading for hazardous waste handlers or recyclers serving the state, DANR's page links lists of contractors, recyclers and service companies, which this handbook did not open.
- A generator ID comes through EPA's form. A business gets a hazardous waste ID number by filing the Notification of Regulated Waste Activity form, either by mailing the signed original to the Waste Management Program in Pierre or through EPA's myRCRAid system. Small quantity generators must notify the state starting September 1, 2021 and every four years after, for most a second notice, on EPA Form 8700-12, and the same form reports a change to very small or large quantity generator status. A record that shows an old status may be out of date; check the latest notification.
- The generator categories turn on monthly amounts. DANR's permitting guide describes RCRA's three categories: a very small quantity generator produces less than 220 pounds of hazardous waste a calendar month, a small quantity generator from 220 to 2,200 pounds, and a large quantity generator more than 2,200 pounds.
The state's hazardous waste law is SDCL 34A-11 and its rules are ARSD Article 74:28, which take in 40 CFR parts 260 to 279 by reference. DANR says the updated state rules took effect August 28, 2023. DANR's page also says EPA runs the e-Manifest system for South Dakota until DANR adds the e-Manifest rule to the state rules.
Where to look a site up
- DANR's Hazardous Waste page links RCRAInfo and EPA pages it labels as generator lists and maps and as inspections and enforcement lists and maps.
- The Hazardous Waste Section is at (605) 773-3153. Notifications go by mail to the Waste Management Program in Pierre, at 523 E. Capitol Avenue (SD 57501), or through EPA's myRCRAid system.
Getting the file
