Federal Facilities and Superfund Programs
The Federal Facilities and Superfund Programs of the Maine Department of Environmental Protection (DEP) cover remediation sites in Maine that are currently or formerly owned by the federal government, or that are on EPA's National Priorities List (NPL), the sites generally known as Superfund sites. DEP says Superfund sites are cleaned up under the regulations of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), and that DEP is a co-regulator with EPA on them. On federal facility sites that are not on the NPL, DEP is the lead regulator.
In a Phase I ESA
The lists themselves are federal. They are described on the NPL page and the SEMS page. What DEP adds is its own records on the sites its Division of Remediation has handled, and the state's view of federal sites that are not on the NPL.
- Non-NPL federal sites are DEP's to lead. DEP says these typically include Formerly Utilized Defense Sites (FUDS), owned or operated by the U.S. Department of Defense before October 17, 1986, as well as National Guard sites and sites owned by other federal agencies such as the U.S. Coast Guard. Sites currently or formerly owned by the Department of Defense are managed under the Defense Environmental Restoration Program (DERP). For property that once belonged to a military or other federal agency, ask DEP whether it has a file.
- DEP names the sites by project manager. The program page lists the Superfund and federal facility sites assigned to each of its project managers, which shows the DEP staff member assigned to a nearby site.
- PFAS is part of the work. DEP's PFAS page says several federal facilities and Superfund sites are undergoing investigation and remediation of PFAS, and that EPA designated PFOA and PFOS as hazardous substances under CERCLA on April 17, 2024. The program page links a memo from the U.S. Assistant Secretary of Defense on prioritizing Department of Defense cleanup actions under DERP to implement the federal drinking water standards for PFAS.
Where to look a site up
The program page points to three sources:
- the remediation sites list and Document Portal, which DEP says includes Federal Facilities and Superfund sites, with historic records on the sites the Division of Remediation has handled;
- the File Room Search, for physical documentation on a site that is hard to find;
- DEP's GIS map of Federal Facilities and Superfund site locations, under the Remediation Sites (Institutional Controls) Database.
This handbook did not open the list, the portal, the search or the map. EPA's own Superfund pages are linked from the program page.
Getting the file
DEP's Administrative Record for remediation sites was on paper until February 2021. Converted files are in DEP's online remediation documents portal, which includes Federal Facilities and Superfund sites. The program page says to check the File Room for physical documentation on a site; the file room is by appointment at (207) 287-7843. See File Room, Reports and Lists.
