Petroleum Contaminated Soil Landfarms

Agency South Dakota Department of Agriculture and Natural Resources

A petroleum contaminated soil landfarm is a site the South Dakota Department of Agriculture and Natural Resources (DANR) permits to treat soil contaminated with petroleum. DANR's Solid Waste Section, part of its Waste Management Program, lists petroleum contaminated soil land treatment among the work it regulates. DANR says the state has permitted many such facilities. Some sit at municipal solid waste landfills or restricted use sites, but most are permitted only to treat petroleum contaminated soil.

In a Phase I ESA

ASTM E1527-21 lists state landfill and solid waste disposal site records among its standard sources, and DANR's Solid Waste Section permits landfarms. The general reading of a landfill listing is on the landfills and solid waste page. Three details shape the search.

  • Landfarms treat soil from petroleum cleanups. DANR's storage tank page links the landfarms page among its cleanup resources. For a property that had a petroleum cleanup, ask where the excavated soil went; for a property that is or was a landfarm, the landfarm permit is the record.
  • A general permit exists for landfarms. DANR publishes a general permit for petroleum contaminated soil landfarms, and an initial and a renewal application for a landfarm site. A facility must have DANR's authorization before it takes waste under a general permit, and DANR says a copy of the general permit does not by itself show that a facility is authorized.
  • The list is given on request. DANR says a list of the facilities permitted to accept petroleum contaminated soil can be requested from the Waste Management Program by email or at (605) 773-3153. The pages read link no such list.

Two DANR pages differ here. The permitting guide's two tables of programs by customer group mark, for petroleum land-farms, a groundwater discharge plan and a surface water permit among the permitting programs and spills among the regulatory programs, and leave the solid waste permit unmarked. The Solid Waste Section's own pages list landfarms among the facilities it permits and publish the landfarm general permit. Ask the Waste Management Program which permits a given landfarm held.

Getting the file

DANR's page footer links Request Public Records, an address on the state's sd.gov portal that this handbook did not open. The pages read do not say where landfarm permit files are kept or what a request must include.
