Waste Tires Permitting

The Louisiana Department of Environmental Quality (LDEQ) requires a waste tire permit for facilities that either process waste tires or collect them. LDEQ says it oversees the program to make sure waste tires are managed safely and used in approved end-use projects.

In a Phase I ESA

ASTM E1527-21 does not name waste tire permits among its standard record sources. A permitted tire processor or collection center is a place where tires were stored, which a records review of a former industrial or commercial site may meet. Four details shape the search.

  • There are two permit kinds. Standard Waste Tire Permits are required for facilities that process waste tires and for centers that collect them. Processors follow LAC 33:VII.10517 and 10525, and collection centers follow LAC 33:VII.10518 and 10527. A facility that uses mobile waste tire processing equipment must also hold a valid waste tire processor permit.
  • Government sites follow another route. Government agencies that run a collection center or a processing facility must notify LDEQ before they begin. LDEQ says they need no standard collection center permit if they follow LAC 33:VII.10525.J (processing) or 10527.H (collection).
  • Processors and collection centers report monthly. LDEQ requires waste tire processors to submit monthly reports by the 12th day of the month, including generator manifests, a processor manifest and unmanifested waste tire logs. Collection facilities submit monthly reports by the 15th day.
  • Closure is funded in advance. LDEQ says permitted waste tire facilities must set aside money, called financial assurance, to cover the cost of closing the facility, and must update it each year. A facility that wants to change ownership, expand or close must update its permit or submit a closure plan.

LDEQ links a Waste Tire Processor List on its permitting page, as a PDF that was not opened for this handbook. The pages read link no list of collection centers.

LDEQ's page also links an Active Waste Tire Generators List and a Waste Tire Transporter List. It describes transporters as businesses or individuals registered with the state to pick up and haul waste tires from generators, such as tire shops or dealerships. It does not say what either list holds.
