Colorado hazardous waste management sites and facilities

The Colorado Department of Public Health and Environment (CDPHE) runs the state's hazardous waste program through its Hazardous Materials and Waste Management Division. CDPHE says it inspects facilities that generate or transport hazardous waste and permitted facilities that treat, store or dispose of it, and investigates complaints about possible mismanagement of hazardous waste.

In a Phase I ESA

CDPHE's hazardous waste records sit beside the federal records described on the RCRA Generators page and the RCRA TSD page. ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single Colorado list with that type; these are the Colorado records that bear on it. The distances the standard sets for each kind of record are on the search distances page.

  • The state list the page links is of permitted facilities. CDPHE's sites and facilities page links a list of hazardous waste permitted facilities, and its permits page links the same document as the Colorado hazardous waste permits listing.
  • CDPHE also points to EPA. The same page links EPA's Enforcement and Compliance History Online facility search, Envirofacts and the Toxic Release Inventory. For the facility search, CDPHE advises using the postal abbreviation when searching by location. The pages read name no state search for generators.
  • A permit runs through closure. CDPHE says most facilities that treat, store or dispose of hazardous waste must have a permit for the active life of the unit, including the closure period. The application has a Part A, which is EPA Form 8700-23 with maps, drawings and photographs, and a Part B, which holds detailed site-specific information in narrative form. Special permits include interim status, permits by rule, and short-term permits such as emergency permits. For a permitted facility, the Part B is where the site-specific description is.
  • Inspection results are reported quarterly. CDPHE's page on finding out whether a site is contaminated links quarterly hazardous waste inspection and enforcement reports, which it describes as covering hazardous waste facilities inspected in the past year.
  • A release makes a second record. CDPHE treats a site where hazardous waste was released to the environment after mid-November 1980 as an unpermitted disposal facility, and says interim status and permitted facilities must clean up releases under the Colorado hazardous waste regulations. The hazardous waste regulations are 6 CCR 1007-3. CDPHE gives the statute as the Hazardous Waste Control Act, Title 25, Article 15, Parts 1, 2, 3 and 5. It cites part 100.4 of the state regulations for what a Part B must contain, and part 100.2 for the criteria that special permits must meet.
