Leaking Underground Storage Tank (LUST) registry
North Dakota's leaking tank list is the Leaking Underground Storage Tank (LUST) registry, kept by the Underground Storage Tank Program of the North Dakota Department of Environmental Quality (DEQ). DEQ says: "The LUST registry includes any site which has had a reported release." The same program keeps the registry of underground storage tanks, and the two registries are compiled into online reports that DEQ links for download.
In a Phase I ESA
The LUST registry is the North Dakota form of the state leaking storage tank records that ASTM E1527-21 lists as a standard source. The general reading of a leaking tank listing is on the LUST page. Four North Dakota details shape how to read a listing.
- A listing records a reported release. The pages read do not say what status terms the registry uses or how it records a closed case. DEQ links a definitions document for its UST facility, LUST facility and UST tank lists from the program page. Read a listing against those definitions and the file before calling a case open or closed.
- The state may have done the work. DEQ says the LUST program uses federal funds to conduct investigations and remediation activities at LUST sites where the owner or operator is unable or unwilling to pay for them, and that the funds used in LUST contracts are cost recoverable.
- The Fund reimburses petroleum cleanups. The Petroleum Tank Release Compensation Fund (PTRCF) reimburses an eligible tank owner for costs of cleaning up petroleum contamination, on the terms set out on that page. For a petroleum case, ask DEQ whether a claim was made to the Fund; the pages read give no public list of claims.
- Contamination found later is reported too. DEQ's spill pages say that soil or water contamination found during a property transfer assessment must be reported to DEQ, and that a previously unknown or historic release is not exempt. See the Spill Investigation Program. Since DEQ says all spills must be reported, search the Environmental Incident Reports for the same address as well.
The program's rules are chapter 33.1-24-08 of the North Dakota Administrative Code, Technical Standards and Corrective Action Requirements for Owners and Operators of Underground Storage Tanks. DEQ's Risk Based Corrective Action (NDRBCA) page lists its procedures for the collection of soil samples at UST sites among related guidance.
Where to look a site up
- The LUST Facility List is linked from the program page, which says to choose a format from the Export drop-down menu. DEQ's Voluntary Response Actions, Data & Maps and Open Records pages link the same list.
- The Definitions For The UST Facility, LUST Facility And UST Tank Lists are linked from the same page.
- DEQ gives the program inbox, ndust@nd.gov, for questions about the UST and LUST database. The Division of Waste Management is at 701-328-5166.
Getting the file
DEQ takes open records requests at DEQOpenRecords@nd.gov, on its General Request Form for general records. Its Open Records page asks that, if a request includes LUST or UST records, you check the UST and LUST online listings first, and it lists a latitude and longitude coordinate among the details to include. The rest are on the Open Records Requests page.
