Conveyance Notices and Use Restrictions
The pages of the Louisiana Department of Environmental Quality (LDEQ) read for this handbook describe two things tied to institutional controls at a cleanup: the conveyance notice, used under the Risk Evaluation / Corrective Action Program (RECAP), and the use restrictions that go with a Partial Voluntary Remedial Action under the Voluntary Remediation Program.
In a Phase I ESA
ASTM E1527-21 lists state registries of institutional and engineering controls as a standard source, and the general reading of such a listing is on the State/Tribal Institutional and Engineering Control Registries page. The LDEQ pages read name no registry of conveyance notices or other controls, so this handbook does not pair the program with that record type. The pages describe documents tied to a site, so the work is finding them.
- A conveyance notice goes with a RECAP closure that needs institutional controls. LDEQ says conveyance notifications under RECAP are required when institutional controls are required for site closure. It says this is most common when residual contamination in soil exceeds non-industrial (residential) standards, or when residual contamination in a Groundwater 2 zone is acceptable for closure but remains too high to use the aquifer for drinking water.
- The form depends on the condition. LDEQ provides a RECAP Conveyance Notice Form and three notice formats: one for industrial surface soils, one for a Groundwater 2 zone, and one for industrial soils and a Groundwater 2 zone together. LDEQ's UST forms page lists a Conveyance Notice Form and a Conveyance Notice format for Industrial Soils and GW2 Zone, described as forms to complete when a conveyance notice is required to close a remediation site. The pages read do not say whether they are the same forms.
- A voluntary action may record restrictions in the parish. LDEQ says every Partial Voluntary Remedial Action requires use restrictions, identified in the Voluntary Remedial Action Plan, and that the use restrictions must be recorded in the parish records. It says a Partial Voluntary Remedial Action may use engineering controls, institutional controls or both.
- Reuse determinations may layer controls. Under the Ready for Reuse Program, LDEQ lists as an eligibility criterion that where contaminants are above an unrestricted use level, institutional controls should be implemented and layered where possible.
Where to look a site up
- The Voluntary Remediation Program's list of enrolled sites, Louisiana VRP Sites - Public Record, notes which sites employ institutional controls. LDEQ calls a PDF it links, VRP Sites Public Record Key for Institutional Controls, the key for that table. It was not opened for this handbook.
- The pages read do not say where a conveyance notice is filed or recorded, or whether LDEQ keeps a list of them. Ask for it in the cleanup file. For a Partial Voluntary Remedial Action, LDEQ says the use restrictions must be recorded in the parish records.
