Superfund and Department of Defense Program

Agency Rhode Island Department of Environmental Management

The Superfund and Department of Defense Program of the Rhode Island Department of Environmental Management (DEM) sits in its Office of Land Revitalization and Sustainable Materials Management. DEM's office page says the program "Includes Brownfields, Superfund, Department of Defense Clean-ups, and evaluation of sites on EPA's CERCLIS list for consideration of action under the Superfund Program." The same page says its remediation staff oversee Superfund cleanups and Department of Defense sites.

In a Phase I ESA

The federal lists are described on the NPL page and the SEMS page.

  • Federal and defense sites are on DEM's own list. DEM's List of CERCLIS and State Sites includes sites investigated under the federal CERCLIS program, which DEM calls "SFA" sites. Among its codes are NPL (National Priority Listed Site (Superfund)), FUDS (Formerly Used Defense Site) and DOD (Department of Defense Site).
  • Old landfills can fall here too. DEM says sites on its list of inactive landfill and dump sites may fall under the jurisdiction of one or more of these programs: Superfund, Site Remediation, the Landfill Closure Program, Department of Defense and/or Pre-Remedial. See the Landfill Closure Program.
  • The program page points to federal sources. It links DEM's own descriptions of the Superfund NPL Program, the Superfund Site Assessment Program and the DOD Site Remediation Program, which this handbook did not open, and pages of EPA and the U.S. Army Corps of Engineers. Its topics include Restoration Advisory Boards and natural resource damage assessments.

DEM's File Reviews page lists National Priorities List files under Waste; it names no area for defense sites.

Getting the file

DEM's File Reviews page lists, among the areas it coordinates, Waste (National Priorities List and landfills) and CERCLIS (files related to Site Remediation); see DEM File Reviews. Submit DEM's Request to Inspect and/or Copy Public Records form. DEM says file reviews are scheduled within 10 business days after the request is received, and gives the mailbox Dem.filereview@dem.ri.gov to schedule one.
