Brownfields/ Voluntary Cleanup Program (BVCP)
The Missouri Department of Natural Resources' Brownfields/ Voluntary Cleanup Program (BVCP) oversees brownfield cleanups and promotes redeveloping brownfields. The department says it does this through three programs: Brownfield Assessments, Voluntary Cleanup and Long-Term Stewardship. This page covers the Voluntary Cleanup part. In a Phase I ESA
Sites in the Voluntary Cleanup Program are the Missouri form of the state voluntary cleanup records that ASTM E1527-21 lists as a standard source. The general reading of a voluntary cleanup listing is on the VCP page. Four Missouri details shape how to read one.
- An application is not a cleanup. The department's list of sites that applied gives each site a status of active, completed, withdrawn or terminated. Check the status before treating a listed site as finished.
- A certificate marks the end. The department says the cleanup certification it issues can greatly reduce the environmental liability of a property. The same list gives the date the certificate was issued for completed sites.
- A completed site can still have conditions. Where residual contamination is safely left after a certificate is issued, the department says an environmental covenant is placed in the property's chain of title and the site enters long-term stewardship.
- The program is not enforcement. The department describes BVCP as a non-enforcement program that provides closure when a property is clean to approved specifications.
What the program is
The Voluntary Cleanup Program was first established by the state legislature in 1994. It provides state oversight for voluntary cleanups of properties contaminated with hazardous substances. The department says many sites entering it are not heavily contaminated and are contaminated by sources not addressed by its regulatory groups, such as Emergency Response, Superfund, the Resource Conservation and Recovery Act (RCRA) program or Petroleum Storage Tanks. To apply, a party submits the application (MO 780-1712) with the fee. The department says its departmental risk-based corrective action guidance applies mainly to voluntary cleanups overseen by BVCP.
The state's authority is cited as Missouri Revised Statutes sections 260.565, 260.567, 260.569, 260.571 and 260.573, and 10 CSR 25-15.010. The department also posts its Memorandum of Agreement with EPA Region 7 for the program.
The Missouri Brownfield Redevelopment Program is run by the Department of Economic Development and the Department of Natural Resources. The Department of Economic Development provides the financial incentives, and BVCP oversees cleanup of all brownfield redevelopment sites, whether state or federally funded.
Where to look a site up
The department's Environmental Cleanup Site Specific Data page offers Excel tables built from its MoWaste system:
- A Site Specific Query listing all BVCP, Superfund and Federal Facility sites with the regulatory group addressing each. The department says it is updated monthly.
- A Site Status List of all sites that applied to BVCP, with status, a brief description, contaminants, acreage, location and certificate date. The department says it is updated monthly.
