Uniform Environmental Covenants Act
The Maryland Department of the Environment (MDE) says Maryland adopted the Uniform Environmental Covenants Act (UECA) effective October 1, 2005, becoming the fifth state to do so.
In a Phase I ESA
MDE says the Land Restoration Program's mapping site holds an electronic registry of properties that contain recorded environmental covenants. This handbook reads that registry as the Maryland form of the state institutional and engineering control registry records that ASTM E1527-21 lists as a standard source, with limits. The pages read speak of environmental covenants and do not use the words institutional control or engineering control. The general reading of such a registry is on the State/Tribal Institutional and Engineering Control Registries page. Three limits follow from what MDE's pages say.
- Land Restoration Program sites. MDE says a generated report of Land Restoration Program sites that maintain environmental covenants can be found on the LRP Site Mapping System. The pages read describe covenants at Land Restoration Program sites and do not say the registry covers covenants from other programs.
- Covenants, not every control. The pages read do not say whether the registry lists engineering controls, or land use controls that are not recorded covenants.
- Other control records. MDE's resources page links a land use control (LUC) report, a land use control compliance fact sheet, and a Residential Redevelopment and Land Use Controls Policy fact sheet (updated April 2022). This handbook did not read those documents.
MDE's UECA page links a UECA fact sheet, an issuance checklist and an Environmental Covenant Report. A link with no text has an address that names an environmental covenant template. This handbook did not read them. The Controlled Hazardous Substance Enforcement Division page says a technical review letter can include land use restriction requirements.
