Oklahoma petroleum storage tank release cases
Releases from regulated storage tanks in Oklahoma are reported to, and handled by, the Petroleum Storage Tank Division of the Oklahoma Corporation Commission. The Division's stated mission includes reducing, mitigating and eliminating the threats posed by petroleum products released from storage tanks.
In a Phase I ESA
The Division's release cases are the Oklahoma form of the state leaking storage tank records that ASTM E1527-21 lists as a standard source. The general reading of a leaking tank listing is on the LUST page.
Three Oklahoma details shape how to read a case.
- A report can be a suspicion. Owners, operators, their employees or agents, and transporters must report to the Division within 24 hours of discovering any substance, condition or monitoring result that indicates a release may have occurred. The Division publishes separate guidance on suspicion of release. A reported case is therefore worth reading for whether a release was confirmed.
- A state fund backs tank owners' financial responsibility. The Division administers the Indemnity Fund, which the Legislature created in 1989 to help tank owners meet the financial responsibility requirement for storage tanks and leaking tanks. One of the Division's technical policies says a case must be fund eligible before initial purchase orders are submitted.
- The rules are the Commission's own. Corrective action is governed by Chapter 29 of the Commission's rules, and the fund by Chapter 27. The Division's technical guidance includes field guidelines, a document titled ORBCA Guidance, and a cleanup responsibility policy.
The Division also reports each year. Under 17 Okla. Stat. section 314 it compiles the new reported releases, and under section 325 it reports on Indemnity Fund claims and audits. It posts a public record summary to comply with the federal Energy Policy Act of 2005.

Getting the file
The Commission takes records requests through the form on its Open Records Requests page, and says most requests are answered within 24 hours. It also says most records about underground or aboveground petroleum storage tanks at fueling stations are available through its Petroleum Storage Tank portal, which is open to the public.
