DMWM Issued Actions/Permits

Agency Ohio Environmental Protection Agency

Issued Actions/Permits is a list posted by the Division of Materials and Waste Management (DMWM) of the Ohio Environmental Protection Agency (Ohio EPA). Each row gives a party, an issue date, a description of the document, in most rows the Ohio Revised Code (ORC) or Ohio Administrative Code (OAC) provision it cites, and, in all but one row, a link to the document itself. DMWM's Scrap Tires page links the list as Issued Actions.

In a Phase I ESA

ASTM E1527-21 does not name an agency's list of issued approvals and permits among its standard record sources. This one matters when a landfill is on or near the property: among its rows are approvals on ground water, explosive gas monitoring, corrective measures and the end of post-closure care, each linked to its document. The general reading of a landfill listing is on the landfills and solid waste page. Four details shape how to use it.

  • It is searched by name. The list gives no address or county. Search it by the facility's name as other records give it, such as the Municipal Solid Waste Landfills or C&DD Landfills licensed facility list.
  • A row says what was issued, not what was found. Open the linked document before reading anything into a description such as Ground Water Non-Approval or Selection of Corrective Measures. The same kind of action can appear under several descriptions: Ground Water Approval, Groundwater Approval and GW Approval, for example.
  • Closed landfill and Chapter 513 rows. Rows citing OAC Rule 3745-27-13, mostly described as Rule 13 Authorization and in five rows as Closed Landfill Authorization, run from April 2015 to December 2019. Rows described as Chapter 513 approvals or authorizations, citing OAC Chapter 3745-513 or rules in it, run from January 2020. The list does not say what either citation covers. Chapter 513 is described on the Developing On or Near a Landfill page.
  • It starts in 2015. When read on October 15, 2026, the list held 2,017 rows, with issue dates from January 6, 2015 to October 6, 2026. For an action before 2015, ask for the file.

The list also carries beneficial use permits and scrap tire approvals; see the Beneficial Use Program and Scrap Tires pages.

What the record shows

Some of the descriptions a Phase I meets, as the list writes them, with the provision the list cites for each in most of its rows:

Document description Provision cited
Ground Water Approval OAC Rule 3745-27-10, or in some rows OAC Rule 3745-30-08
Ground Water Non-Approval OAC Rule 3745-27-10
Selection of Corrective Measures OAC Rule 3745-27-10(F)
Explosive Gas Monitoring Plan Approval OAC Rule 3745-27-12
Authorization to Discontinue Explosive Gas Monitoring OAC Rule 3745-27-12
End of Post-Closure Care Period OAC Rule 3745-27-14
Rule 13 Authorization OAC Rule 3745-27-13
Closed Landfill Authorization OAC Rule 3745-27-13
Chapter 513 Approval OAC Rule 3745-513-20(A) or OAC Chapter 3745-513
Individual Beneficial Use Permit OAC Chapter 3745-599

The list has many more descriptions, among them exemptions, variances, permits to install and solid waste management plan approvals. Read each description as the list prints it; the page does not define them.

Where to look a site up

  • The list is on Ohio EPA's Issued Actions/Permits page. To see the newest actions first, the page says to click the Issue Date column title twice.
  • Names of currently licensed facilities are on DMWM's Licensed Solid Waste and C&DD Facilities page. Ohio EPA says that list shows only currently licensed facilities.
  • DMWM is at 614-644-2621.

Getting the file

Each row but one carries a link to its document. To see the rest of what is online for the same facility, Ohio EPA says that once one document is found in its eDocument search, the related documents folder icon shows all the documents in the system for that facility. For records that are not online, use the online file review request form. Ohio EPA has no central repository for all its records: each division and district office stores its own files, and the best first contact for a file review is the district office where the facility is located. See Access Public Records.
