Hazardous waste generator registrations

Agency Kentucky Department for Environmental Protection

The Hazardous Waste Branch of the Division of Waste Management, in the Kentucky Department for Environmental Protection (DEP), is delegated authority from EPA to manage the regulations of the Resource Conservation and Recovery Act (RCRA). Its Administrative Support Section manages the hazardous waste generator registrations and annual reports for the Commonwealth. DEP uses one electronic form for both, eForm #108, the Hazardous Waste Form 8700 RCRA Form, which takes in EPA's 8700 form and Kentucky's addendum forms, and encourages its use; the branch also posts paper forms and a mailing address.

In a Phase I ESA

This is the state record of who generated hazardous waste at an address. It sits beside the federal generator records described on the RCRA Generators page. ASTM E1527-21 lists state hazardous waste facility records among its standard sources. This handbook does not pair a single Kentucky list with that type; this is one of the Kentucky records that bear on it.

Three Kentucky details shape how to read one.

  • The EPA ID number comes from this form. DEP says a generator or transporter receives an EPA ID number by submitting eForm #108. A change of generator status, added waste streams or new contact details go on the same form. If a registration is not received, the EPA ID number may be deactivated.
  • Closing out depends on size. For a large quantity generator, DEP says site closure and deactivation of the EPA ID number require a clean closure performance standard under 40 CFR 262.17(a)(8), a field inspection of the facility, and the 8700-12 form. A small or very small quantity generator sends a request to be removed. For a former large quantity generator, ask for the closure inspection.
  • Annual reports are not filed by everyone. Large and small quantity generators must file an annual report in Kentucky. Very small quantity generators do not, unless they held small or large quantity status at any point in the reporting year. Annual reports are due January 1, with a grace period to March 1 before late fees.

DEP defines a generator as any person, by site, whose act or process produces hazardous waste identified or listed in 40 CFR 261, or whose act first causes a hazardous waste to become subject to regulation.

Where to look a site up

The pages read link no Kentucky list of generators. The Hazardous Waste Branch's information page links EPA's Enforcement and Compliance History Online (ECHO) search. The Cabinet's eSearch lists searches for permits, licensed operators and invoices. The Division of Waste Management takes general questions at waste@ky.gov or 502-564-6716.

Corrective action at hazardous waste treatment, storage and disposal facilities is on the Permit Review and Corrective Action page.

Getting the file

The Cabinet takes open records requests by email to EEC.KORA@ky.gov, with as much detail as possible about the records sought. The Hazardous Waste Branch's information page links 400 KAR 1:060, a regulation on the confidentiality of records. Only residents of the Commonwealth, as the Open Records page defines them, may request to inspect public records.
