A Phase I records review in Arkansas runs mostly through one agency, the Division of Environmental Quality (DEQ). DEQ is a division of the Arkansas Department of Energy and Environment (E&E). The Transformation and Efficiencies Act of 2019 (Act 910) created that department, which took in the former Arkansas Department of Environmental Quality under its new name, and DEQ is still the state's environmental regulator. DEQ's Office of Land Resources oversees the storage tank, brownfield, hazardous waste and solid waste programs that make up most of this page. This page maps each kind of record ASTM E1527-21 asks for to the Arkansas program behind it, and links a page on each program.
The standard record types, in Arkansas
| ASTM record type | Arkansas program | Agency |
|---|---|---|
| State Superfund equivalent | RATFA State Priority List (SPL): the sites added by rulemaking to the priority list kept under the state's Remedial Action Trust Fund Act. DEQ does not call it a state Superfund list; the pairing rests on DEQ's description of the Act. | DEQ |
| State hazardous waste facilities | No single Arkansas list is paired here. The Arkansas records that bear on it are the Hazardous Waste Generators Facility Summary and DEQ's Hazardous Waste Treatment, Storage, and Disposal Facilities page. | DEQ |
| Landfills and solid waste sites | Permitted solid waste facilities: DEQ's search of the solid waste facilities it permits, which this handbook did not open | DEQ |
| Leaking storage tanks | Leaking Underground Storage Tank (LUST) cases: when a facility reports a suspected tank release, DEQ records the report in its LUST database, and its Regulated Storage Tanks page says its online searches cover leaking tank information | DEQ |
| Registered storage tanks | Regulated Storage Tanks (RST) registrations | DEQ |
| Institutional and engineering controls | No single Arkansas list is paired here. The pages read name no registry of controls. DEQ's page on the Elective Site Cleanup Agreement (ESCA) Program says a finished cleanup may leave limits on using the site or its groundwater, set by land-use controls or deed restrictions. | DEQ |
| Voluntary cleanup sites | The Elective Site Cleanup Agreement (ESCA) Program, which DEQ describes as a way for the responsible parties of a contaminated site to clean it up voluntarily, and which has a listing of its own. The Brownfield Voluntary Cleanup Program is run by the Brownfield Program; the pages read do not say whether its Brownfield Property Listing marks which projects are voluntary cleanups, so pairing that listing here is the handbook's reading. | DEQ |
| Brownfields sites | Brownfield Program: its Brownfield Property Listing | DEQ |
How far each search reaches is on the ASTM search distances page.
Other Arkansas records worth reading
These are not paired with a record type in the table above, but each answers a question an Arkansas Phase I runs into.
- Petroleum Storage Tank Trust Fund: which tank releases the state fund helps pay to clean up, and the deductible by release date.
- Clandestine Laboratory Cleanup (Meth Lab): the list of meth-contaminated properties, and why DEQ may hold no file once one is cleaned up.
- Spills and emergency response: where a spill is reported, and the spill registry DEQ does not put online.
- Pollution complaints and inspections: the complaint and inspection searches, one of them of SEEK complaints data.
- Legal Orders Database: consent administrative orders, notices of violation and the other legal actions DEQ has taken against permitted facilities.
- Underground Injection Control (UIC) Program: which agency has which well class, and DEQ's permits for non-domestic wastewater dispersed below ground, which DEQ says car and truck washes, dog kennels and laundromats most often hold.
- Environmental Professional Certification: what DEQ says about the qualifications for a Phase I done to satisfy all appropriate inquiries, and DEQ's list of environmental professionals.
- Records Management and FOIA requests: how to see or copy a DEQ file.
One division, and the agencies beside it
DEQ's own programs cover most of what a Phase I asks of the state. Its pages name other offices that hold the rest.
- Oil and gas. DEQ's UIC page says Class II injection wells, and the Class V wells that take spent brine from bromine production, are regulated by the Arkansas Oil and Gas Commission (AOGC). DEQ's home page lists the Oil & Gas Commission among the department's divisions. This handbook does not read the Commission's site and has no page on oil and gas wells.
- Aboveground tanks. DEQ's tank pages put the technical standards for aboveground tanks in the Arkansas Fire Prevention Code (the page names its 2014 Edition), which the Arkansas State Fire Marshal's Office enforces (501-618-8624).
- Spill plans. DEQ says EPA has not delegated its Spill Prevention Control and Countermeasures (SPCC) program to DEQ, and sends questions on SPCC plans to EPA Region VI at 214-665-6702.
- Emergencies. DEQ's pages send a spill that needs an immediate emergency response first to the Arkansas Division of Emergency Management (ADEM) at 501-683-6705 (some DEQ pages call it the Department of Emergency Management).
- Superfund. DEQ's Superfund page, which still calls the agency the Arkansas Department of Environmental Quality, says 13 Arkansas sites have been placed on the National Priorities List and five of them have since been removed, and that DEQ is a support agency to EPA for work on 10 of those sites and the lead agency on two. The page gives no date for these counts, and its own table lists 15 sites.
- Septic systems. DEQ's UIC page says a below-ground system for domestic wastewater serving fewer than 20 people a day needs approval from the Arkansas Department of Health and no DEQ permit.
DEQ's online searches
DEQ's Databases page lists its online searches office by office. For a single facility or permit it points to the DEQ Facility and Permit Summary (PDS). Many of DEQ's listings carry a facility's AFIN, which DEQ's definitions page spells out as the Arkansas Facility Identification Number, a number based on the county and tied to one address. The brownfield, ESCA and State Priority List listings all show it, so note the AFIN of every facility at the address.
DEQ's SEEK Help page calls SEEK the department's new data management system. The programs it lists as now in SEEK include regulated storage tanks, solid waste general permits, compliance actions and self-disclosures. DEQ's tank page says tank compliance moved into SEEK on January 11, 2024, and that SEEK will host the most current information formerly found in the Storage Tank Facility Data Search. Legal orders have one search for orders processed in SEEK and another for orders processed outside it, and the Pollution Complaints page links a search of SEEK complaints data beside a search of DEQ complaints and inspections data (DEQ's Databases page labels the first of these DEQ Complaints and Inspections Data). Run each one.
The Databases page also links four GIS viewers, which this handbook did not open: EnviroView, AquaView, the Arkansas Brownfield Program Viewer and MethViewer.
Getting a file from DEQ
A listing says a record exists. The reports and letters are in the file. DEQ's Records Management page says DEQ keeps files on the facilities it regulates, covering permits, enforcement, compliance, environmental reports and discharge or emissions monitoring, most of them in electronic form, and that many can be reviewed from its website. The page lists two things not found online: files that staff are using, and the registry of petroleum and chemical spills from transportation and facilities.
- Freedom of Information Act (FOIA) requests go by email to the public information coordinator at EE.FOIA@arkansas.gov. The Records Management page calls the coordinator DEQ's; the Contact Us page and the tank program's page call the coordinator the Department of Energy and Environment's. The Attorney General's FOIA page says the Act opens public records to Arkansans, with some exceptions, and its 2026 FOIA Handbook says the right belongs to any citizen of the State of Arkansas, corporations included; the records page below has more.
- To arrange a visit to review files, the Contact Us page points to the Records Management Section. DEQ is open Monday to Friday from 8:00 a.m. to 4:30 p.m., except holidays, at 5301 Northshore Drive, North Little Rock, AR 72118-5317. The E&E main switchboard is 501-682-0744 (toll-free 888-233-0326).
- The Records Management page gives copy charges of 5 cents a paper page and $1 for each CD or DVD.
The Records Management and FOIA requests page has the rest.
