Underground Storage Tank (UST) Registrations

The Louisiana Department of Environmental Quality (LDEQ) registers underground storage tanks through its Underground Storage Tank Division. The Division's page says there are just under 10,000 underground storage tanks statewide storing petroleum based and/or hazardous substances, regulated under Louisiana Administrative Code (LAC) Title 33, Part XI. The page gives no date for that count.

In a Phase I ESA

LDEQ's UST registrations are the Louisiana form of the state registered storage tank records that ASTM E1527-21 lists as a standard source. The general reading of a registered tank listing is on the UST / AST page. A registration says a tank system exists or existed. Releases are a separate record, the UST remediation case.

Four Louisiana details shape the search.

  • Not every old tank had to be registered. LDEQ says every tank that fits its definition of a UST must be registered unless it was filled with a solid inert material before January 1, 1974, or removed from the ground before May 8, 1986. For a site with a long history, ask about tanks from before those dates, which the registration rule on the page does not reach.
  • Some tanks are outside the definition. The page lists tanks the term does not cover, among them farm or residential tanks of 1,100 gallons or less storing motor fuel for noncommercial purposes, tanks storing heating oil for consumptive use on the premises where stored, and septic tanks. It also lists systems excluded from the UST regulations, among them any UST system with a capacity of 110 gallons or less.
  • Aboveground tanks are somewhere else. The Division does not regulate aboveground storage tanks. The page says the Louisiana State Fire Marshal's Office regulates them, and that LDEQ's water quality regulations (LAC 33:IX, Chapter 9) apply spill prevention control to aboveground tanks over 660 gallons.
  • The file can hold amended registrations. LDEQ requires an amended registration within 30 days after a change in ownership, a change in the status of the system such as temporary closure, a change in service, added or replacement tanks, or an upgrade. A seller must notify LDEQ in writing within 30 days after the sale, with a bill of sale and the new owner's name and contact details. Ask for the whole sequence, not the latest form.

The registration form and certificate

The registration form is UST-REG-01. LDEQ issues a Certificate of Underground Storage Tank Registration only after it has the completed form and the fees. Fees are annual, billed for the State of Louisiana fiscal year (July 1 through June 30), and the page says they must be paid whether or not the tanks are in use or have been closed during the year.

Where to look a site up

  • LDEQ links a UST Issued Certificate Report, which it describes as a list of sites that are current on UST registration fees. Because the page describes it only that way, do not read a site's absence from it as proof that no tank was registered; ask the Division.
