State/Tribal IC/EC Registries

State registries of institutional controls (deed restrictions, environmental covenants, groundwater use prohibitions) and engineering controls (caps, vapor mitigation, barriers) recorded at sites closed under state cleanup, tank, voluntary cleanup, and brownfield programs. Many states implement these as environmental covenants recorded in land records under a UECA-style statute.

In a Phase I ESA

The ASTM E1527-21 search scope is subject property only. This registry is where a closed state case reveals its terms. Closure conditioned on a control means residual contamination was left in place, which is the fact pattern of the controlled recognized environmental condition (CREC).

The working questions: what does the instrument actually restrict (groundwater use, residential use, excavation, building without vapor controls), is the current use consistent with it, and does the buyer's intended use collide with it. ASTM separately lists local land records for activity and use limitations. The state registry and the county recorder do not always agree; consultants treat the recorded instrument as the authoritative document.
