Florida Contaminant Cleanup Target Levels (Chapter 62-777)

Chapter 62-777, F.A.C., is the Florida rule titled Contaminant Cleanup Target Levels. The Florida Department of Environmental Protection (DEP) posts two tables for it: Table I, groundwater and surface water cleanup target levels, and Table II, soil cleanup target levels. This is not a list of sites. It is the set of numbers the cleanup programs in this section refer to. This page says what the tables are and where DEP posts them. It does not repeat any value from them; the values are on this handbook's Florida cleanup levels pages, one per substance.

In a Phase I ESA

When a Florida record says a site was closed, the next question is which target levels it was measured against, and when.

  • Two tables, by medium. Table I covers groundwater and surface water. Table II covers soil. DEP lists both under the heading "Tables for 62-777".
  • The chapter was last amended in 2005. DEP's rules page gives April 17, 2005 as the date of the chapter's latest rulemaking. DEP's technical report on how the levels were developed is dated February 2005.
  • There was an earlier set, from 1999. DEP posts two comparison tables of the May 26, 1999 and April 17, 2005 cleanup target levels, one for groundwater and surface water and one for soil. Check the date of a closure against those dates, because an earlier closure may have been measured against earlier levels.
  • Before the rule there was guidance. DEP keeps a list of older documents, among them groundwater guidance concentrations from 1986, 1989 and 1994 and soil cleanup goals from 1995 and 1996. It says they have been partly or completely replaced by Chapter 62-777 and other rules, are provided for historical reference only, and generally do not apply to current cleanups. For the applicability of superseded target levels it points to rule 62-780.150(4), F.A.C.
  • A site can close on other numbers. DEP's pages describe alternative cleanup target levels, which a risk assessment may propose for groundwater or soil. DEP notes that use of an alternative scenario for risk-based closure may also require institutional or engineering controls. A closure that left contamination above a table level is a reason to check the Institutional Controls Registry.
  • Check the value against the rule. DEP files each table's page as a guidance document and posts the table as a workbook. The rule text is in the Florida Administrative Code, which DEP links from its rules pages. Confirm a value against the rule before citing it in a report.
