Oklahoma spill reports and environmental complaints

The Oklahoma Department of Environmental Quality (DEQ) takes spill reports and environmental complaints through one 24-hour hotline, 1-800-522-0206. Complaints are handled by its Environmental Complaints and Local Services Division, whose environmental specialists work from 21 offices across the state.

In a Phase I ESA

ASTM E1527-21 does not name state spill or complaint lists among its standard record sources. The federal counterpart of a state spill list is the emergency response record described on the ERNS page. Oklahoma's records still matter, because a complaint or a spill report can be the only record of an event that never became a cleanup case.

  • Complaints are a record type you can ask for. DEQ says its local environmental specialists respond to all citizen complaints regarding environmental pollution. When requesting records, DEQ asks you to say whether you want land, air, water, or environmental complaints and local services documents. Name that last category if complaint history is what you want.
  • A spill report has a written follow-up. DEQ's spill reporting page describes the federal emergency notification rule: a facility must immediately report an accidental release at or above the reportable quantity, and must submit a written follow-up notice to local and state officials as soon as possible after the release. DEQ publishes a follow-up form. DEQ's page does not say where filed notices are kept, so ask Central Records and the Local Emergency Planning Committee.
  • A federal report is separate. If the substance is regulated under the federal Superfund law, the National Response Center must be notified in addition to state and local officials. A release can appear in one record and not the other.
  • Oil and gas spills go elsewhere. Spills from oil and gas exploration and production are reported to the Oklahoma Corporation Commission. See oil and gas spills and incidents. The Commission's guidance adds that a spill affecting surface water in the watershed of a water supply lake should also be reported to DEQ's hotline.

Getting the file

DEQ's Central Records office holds the agency's files. Requests go through its online request form, in person at 707 N. Robinson in Oklahoma City, or by phone at 405-702-1188. DEQ asks that a request give the date range, the facility ID number or the facility or company name, any permit number, and whether the records wanted are land, air, water, or environmental complaints and local services documents.
